PRIVACY NOTICE

In compliance with the Mexican Federal Law on Protection of Personal Data Held by Individuals (hereinafter, “LFPD”), we make this privacy notice available to you, and in this regard, we inform you of the following:

1. The Responsible for the protection of your personal data.

AERO CHARTER DE MÉXICO, S.A. DE C.V. (hereinafter, “AERO CHARTER”), with address to hear and receive notifications at Av. Paseo de Las Palmas No. 215, Piso 5, Oficina 503, Colonia Lomas de Chapultepec, Alcaldía Miguel Hidalgo, C.P. 11000, Mexico City, Mexico, is responsible for the treatment and protection of your personal data.

2. Information about our privacy officer and how to make contact.

Our privacy officer is the person within AERO CHARTER who, in compliance with article 30 of the LFPD, has been formally appointed to:

Respond to the requests of the holders of personal data for the exercise of their rights; and
Promote and ensure the protection of personal data in our possession.

3. Personal data that we collect from you.

To carry out the purposes indicated in article 4 of this Privacy Notice, we will collect the following categories of personal data: (i) Identification data; (ii) Contact Information; (iii) Patrimonial Data; and (iv) Financial Data.

3.1. Sensitive Personal Data.

We do not collect sensitive personal data from our clients.

3.2. Personal Data of Third Parties.

For the personal data of third parties that you provide us, you must first have the consent of the holder of said data and inform them of the site where they can find and learn about this Privacy Notice. AERO CHARTER will comply at all times with the provisions of the LFPD and its Regulations regarding the processing of personal data obtained indirectly.

4. Purposes of the processing of the collected personal data.

Your personal data is collected for the following primary and secondary purposes:

a) Primary. Purposes that give rise to and are necessary for the legal relationship between you and AERO CHARTER, which include, without limitation:

To identify and contact you.

To provide you with the information you request, make quotes, notify you of delays, cancellations and the general status of your shipment; as well as monitoring, updating and confirming the services agreed hereupon.

To execute agreements.

To verify data for the authorization of transportation of special merchandise.

To registry data for the transport and/or transfer of cargo in the system for its operational process.

For refunds and bonus procedures for operational errors, forgiveness, reissues and withdrawals.

To integrate the corresponding file and process it, in case of claims.

If applicable and appropriate, to the grant of credits.

To the elaboration of bills.

To the fulfillment of regulatory requirements and obligations with the competent authorities, as well as to attend to requirements or resolutions of governmental or judicial authorities in Mexico or abroad.

To provide the data of the sender and the consignee of the shipment to different government authorities in advance.

Video surveillance and recordings for security reasons.

b) Secondary. Different purposes that do not give rise to the legal relationship between you and AERO CHARTER, but that are of the utmost importance and usefulness to us for:

Inform you and/or offer you products, services and promotions of companies in our corporate group (through AERO CHARTER or by contacting these companies directly).

Marketing and publicity.

Commercial prospecting with companies affiliated to AERO CHARTER.

Surveys, evaluation and monitoring of the cargo services provided.

Refusal to process your personal data for secondary purposes.

In case you do not want your personal data to be processed for the aforementioned secondary purposes, or any of them, you can deny your consent from this moment by sending your request to our privacy officer, who will show you the procedure to exercise your right. Your refusal in this regard shall not be a reason for us to deny you the services and products that you request or agree with us.

5. Transfer of your personal data.

For the fulfillment of the primary purposes indicated in article 4 of this Privacy Notice, your personal data may be transferred to the following individuals or legal entities, without your consent being legally required in terms of article 37 of the LFPD.

Tax Administration Service: for the issue of the digital tax receipt.

Insurance companies: to review claims and, in case of proceeding, to pay them.

Airlines and transport companies: when the cargo intended to be sent is greater than the capacity of the AERO CHARTER aircraft and/or the operating companies with which AERO CHARTER works, or when an air or land connection is required to an airport or city beyond the network operated by AERO CHARTER and/or the operating companies with which AERO CHARTER works, in order to provide the agreed service.

Airport service companies (GHA): when maneuvering, custody and storage of the merchandise are required at any of the airports (origin, destination or transit).

National or foreign marketing companies (GSA’s): responsible for the sale and collection of cargo transportation services; as well as providing follow-up to shipments.

Courier and/or parcel companies: in this case, personal identification and contact data are transferred to send the shipment to the address you specify (home delivery).

National and/or foreign governmental authorities: to comply with the corresponding legal provisions, meet their requirements regarding the cargo registration and for security reasons; as well as for the clarification of incidents or the exercise of any right.

Judicial authorities in Mexico or abroad to meet requirements that may be of your interest: This implies that you can be contacted by the corresponding authority, or whoever it has designated, to inform you about: (i) AERO CHARTER legal processes in which you may have an interest; and/or (ii) how to exercise your rights, if you have them, (without limitation that you can exercise them in the way you think necessary or convenient).

Companies that are part of the AERO CHARTER corporate group or those that operate under our same internal processes and policies: to provide you with a better service and comply with our internal regulations. These companies will establish administrative, technical and physical security measures that allow us to protect your personal data against damage, loss, alteration, destruction or a use other than that the indicated in this Privacy Notice.

Doctors, paramedics or health service providers, in the event of an accident, medical emergency or health situation: in order to be able to assist you.

Third parties: in the event that AERO CHARTER carries out a merger, divestiture, sale, liquidation, bankruptcy or any other type of transaction that involves the transfer of all or part of its assets or business to another company that operates under our same internal processes and policies, becoming part of your corporate group. In these cases, we may transfer your personal data to said third party to inform you and offer to you products and/or services.

Likewise, with your consent, we may carry out the following transfers of your personal data:

In the event that AERO CHARTER carries out a merger, sale, divestiture, liquidation, bankruptcy or any other type of transaction that involves the transfer of all or part of its assets or businesses by a company or entity that does NOT operate under our same internal processes and policies, to inform you and offer to you products and/or services. In the event that, derived from any legal process, be it corporate liquidation or judicial bankruptcy, in Mexico or abroad, we need to transfer our assets and databases to creditors determined by the authority, to comply with our legal obligations.

To carry out these last two transfers, and only in the event that any of these assumptions occurs, we would previously request your express and written consent in the terms of the LFPD.

6. ARCO Rights.

In the terms of the applicable regulations, you have the right to know what personal data we have about you, what we use them for and the conditions of use that we give them (Access). Likewise, it is your right to request the correction of your personal data if it is outdated, inaccurate or incomplete (Rectification). Additionally, you have the right to have your personal data removed from our records or databases when you consider that they are not being used properly (Cancellation). Finally, you have the right to object to the use of your personal data for specific purposes (Opposition). These are known as ARCO rights.

To exercise any of the ARCO rights, you must submit the respective request through an email to our privacy officer to: arco@aerocharter.com.mx, who will inform you about the procedure and requirements for the exercise of those rights, response times, the way in which we will make your right effective, and any questions, complaints or comments you may have in this regard will be addressed.

7. Mechanisms and procedure to revoke your consent.

In the terms of the applicable regulations, you can revoke the consent that, if applicable, you have granted to us. However, it is important that you consider that your request may not proceed in all cases or that we will not be able to terminate the use immediately, since it is possible that due to some legal obligation we need to continue using your personal data.

To revoke your consent, you must submit the respective request through an email to our privacy officer to: arco@aerocharter.com.mx, who will inform you about the procedure and requirements for the exercise of those rights, response times, the way in which we will make your right effective, and any questions, complaints or comments you may have in this regard will be addressed.

8. Options to limit the use or disclosure of your Personal Data.

In addition to the procedure and exercise of the rights contemplated in articles 6 and 7 of this Privacy Notice, you can limit the use or disclosure of your personal data in the following ways:

For marketing and advertising purposes, you can express your refusal by checking the box “I do not wish to receive emails”, which is found at the bottom of the emails that we send you.

By sending an email to our privacy officer to: lfpd@aerocharter.com.mx, in which you request your registration to the “AERO CHARTER Advertising Exclusion List”, so that we do not use your personal information for promotional, advertising or marketing purposes.

By registering in the Public Registry to Avoid Publicity of the Federal Consumer Attorney’s Office (PROFECO, for its acronym in Spanish). 10. Modifications to this Privacy Notice.

We reserve the right to make modifications or updates to this Privacy Notice at any time in response to new legislation, internal policies or new requirements for the provision or offering of our services or products. The updated version will be available through the following means:
